Limited Warranty:

 

During the Warranty Period, as defined below, Hoverstream or its agent will repair or replace, free of charge, any part, or parts, of the Hoverstream Hovercraft that are defective in material and/or workmanship.

 

Hoverstream Hovercraft are covered by the Limited Warranty during the following time periods (“Warranty Period”):

  • for 12 Months or 250 hours from the date of delivery, whichever is first to occur, for non-commercial use; or

  • for 3 months or 250 hours from the date of delivery, whichever is first to occur, for commercial use.

Please remember, hovercraft are more comparable to aircraft than boat/land-based vehicles and often operate in harsh, dusty or extreme conditions.  THIS LIMITED WARRANTY IS VOID IN THE EVENT OF (1) failure to maintain your Hoverstream Hovercraft correctly or service it regularly, as described in this User Manual; (2) operation of your Hoverstream Hovercraft by drivers without training by Hoverstream or prior hovercraft experience unless supervised by an individual who has been trained by Hoverstream or has prior hovercraft experience; (3) failure to remove salt water promptly after operation; (4) continued use of the Hoverstream Hovercraft with a suspected defect; (5) your or an unauthorized third party’s modification to or repair of your Hoverstream Hovercraft or any part thereof.

Terms & Conditions:

Suspected warranty claims must be reported by telephone immediately upon discovery and followed up in writing, within 14 days.  You must provide to Hoverstream all requested information and evidence to support the suspected warranty claim.  To the extent possible, Hoverstream will determine, in its sole discretion, whether such suspected defect falls within the Limited Warranty without in-person inspection.  However, if such determination cannot be made, you are responsible for transporting your Hoverstream Hovercraft to Hoverstream’s place of business or to other authorized personnel per Hoverstream’s instructions, as further explained below. 

The Hoverstream Hovercraft must be returned to Hoverstream’s place of business as soon as reasonably possible following discovery of any suspected defect at your expense both to Hoverstream’s place of business and back to you following conclusion of inspection and/or repairs, as applicable.  In the alternative, if there is are authorized personnel in your area for the particular suspected defect, Hoverstream may arrange for repairs with such authorized personnel, either under the Limited Warranty or at your expense if the issue is not covered by the Limited Warranty (upon obtaining your prior approval).

Hoverstream may, at its discretion after consultation with you, send you a replacement part if diagnosis of a defect is clear and replacement does not require qualified knowledge or expertise.  By accepting replacement parts, you confirm your ability to install such parts to OEM standards and release Hoverstream from any losses, damage or injury caused by improper diagnosis or installation. You also agree to return the defective part(s) to Hoverstream within 30 days of replacement or you will be responsible for the cost of the replacement(s).  YOU ACCEPT ALL LIABILITY AND RESPONSIBILITY FOR ENSURING YOU OR YOUR CONTRACTOR IS PROPERLY QUALIFIED TO INSTALL ANY REPLACEMENT PART TO OEM STANDARDS AND RELEASE HOVERSTREAM ANY LOSSES, DAMAGE OR INJURY CAUSED BY IMPROPER DIAGNOSIS OR INSTALLATION.

While Hoverstream will endeavour to diagnose and repair, as applicable, your Hoverstream Hovercraft as quickly as possible, Hoverstream cannot guarantee repair of your Hoverstream Hovercraft, or its return to you, within any particular period of time (either by Hoverstream or its authorized personnel).  Hoverstream will consult with you regarding the time required for such diagnosis or repair on a case by case basis.

No replacement or loan Hoverstream Hovercraft will be supplied during diagnosis or repairs.  No compensation is due to you, under any circumstances, for any defects in material or workmanship, including, but not limited to, losses if your Hoverstream Hovercraft are used for commercial purposes.

All parts replaced under this Limited Warranty become the property of Hoverstream.

EXCEPT FOR SUCH LIMITED WARRANTY DESCRIBED IN THIS USER MANUAL, HOVERSTREAM DISCLAIMS AND EXCLUDES ALL OTHER WARRANTIES, WHETHER STATUTORY, EXPRESS, OR IMPLIED (INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT OR ARISING UNDER USAGE OR TRADE OR COURSE OF PERFORMANCE.  THIS LIMITED WARRANTY ALSO EXCLUDES DAMAGE OR FAILURE CAUSED BY (1) MISUSE, (2) NORMAL WEAR AND TEAR, (3) IMPROPER MAINTENANCE OR REPAIR, (4) TRANSPORTATION AND LOADING OR UNLOADING, (5) EXCESSIVE SKIRT WEAR (FOR TIME OF OPERATION), (6) AGGRESSIVE OPERATION (7) INGRESS AND/OR EGRESS OBSTACLES, (8) UNSECURED ITEMS DURING OPERATION, AND (8) ANY OTHER REASON OR EVENT THAT IS NOT DUE TO DEFECTS IN MATERIAL OR WORKMANSHIP. 

Hoverstream Hovercraft are only to be driven by drivers with operating knowledge that have undertaken a training session with Hoverstream or are operating under instruction and supervision of someone trained or experienced in the operation of hovercraft.  You are responsible for awareness of your surroundings and the possibility of breakdown in remote locations.  Please be prepared for the possibility of difficult or lengthy recovery in remote locations.

Limitation of Liability:

 

NOTWITHSTANDING ANYTHING TO THE CONTRARY IN THIS LIMITED WARRANTY OR USER MANUAL, EXCEPT FOR THE COST OF PARTS AND LABOR FOR PROPER CLAIMS UNDER THIS LIMITED WARRANTY, IN NO EVENT SHALL HOVERSTREAM BE LIABLE TO YOU OR YOUR CUSTOMERS OR INVITEES FOR DIRECT, INDIRECT, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES IN CONNECTION WITH USE OF HOVERSTREAM HOVERCRAFT, WHETHER IN CONTRACT, WARRANTY, TORT, STRICT LIABILITY, OR OTHERWISE, INCLUDING, BUT NOT LIMITED TO, INJURY, LOST PROFITS, LOSS OF USE, DAMAGE TO GOODWILL OR LOSS OF BUSINESS IN CONNECTION WITH THIS AGREEMENT, EVEN IF IT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOU HEREBY WAIVE, ON BEHALF OF YOURSELF AND YOUR CUSTOMERS AND INVITEES, ANY AND ALL CLAIMS FOR SUCH DAMAGES, INCLUDING ANY CLAIM FOR LOST PROFITS, LOSS OF USE, DAMAGE TO GOODWILL OR LOSS OF BUSINESS WHETHER ARISING IN CONTRACT, TORT OR OTHERWISE.
